The Services may provide general information about buying, selling, investing in, renting, or managing real estate; downloadable guides; property-related content; appointment scheduling; inquiry forms; and communications with our team. We may modify, suspend, or discontinue any portion of the Services at any time.

3. No Professional Advice or Agency Relationship

Website content, guides, market commentary, calculators, emails, and text messages are provided for general informational and educational purposes only. They are not legal, tax, accounting, financial, lending, appraisal, inspection, engineering, or other professional advice. You should consult appropriately licensed professionals regarding your particular circumstances.

Your use of the Services, submission of an inquiry, download of a guide, or participation in an initial consultation does not by itself create a broker-client, agent-client, fiduciary, advisory, or other professional relationship. A real estate agency relationship is created only through a separate written agreement signed by the appropriate parties.

If you affirmatively opt in to the Casa Is Home text messaging program, you may receive SMS or MMS messages related to real estate inquiries, requested guides, consultation confirmations and reminders, customer service, follow-up communications, market or service information, and promotional messages consistent with the consent you provided.

8.2 Consent and Enrollment

You may opt in through an unchecked website checkbox, a consultation or guide-request form, a text keyword, a written form, or another documented method that clearly describes the messages you will receive. By opting in, you authorize Casa Is Home and its service providers to send recurring automated or non-automated text messages to the mobile number you provide. Your consent is not a condition of purchase.

8.3 Message Frequency and Charges

Message frequency varies based on your requests, appointments, and engagement. Message and data rates may apply. Contact your wireless provider for information about your plan. You are responsible for charges imposed by your carrier.

8.4 Opting Out

You may opt out at any time by replying STOP to a Casa Is Home text message. We may send one final confirmation message after processing your request. We will also honor other reasonable requests to revoke consent as required by applicable law. After opting out, you may still receive non-marketing messages when legally permitted or necessary to complete a transaction or respond to a separate request you initiate.

8.6 Mobile Number Responsibility

Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Wireless carriers are not liable for delayed or undelivered messages. The SMS program may not be available through all carriers or devices.

8.8 Mobile Information

We do not control and are not responsible for third-party content, availability, security, privacy practices, or terms. A link does not necessarily constitute an endorsement. 13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." CASA IS HOME AND ITS OWNERS, BROKERS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASA IS HOME AND ITS OWNERS, BROKERS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR REAL ESTATE OR INVESTMENT LOSSES ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US SPECIFICALLY FOR THE ONLINE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT OR ONE HUNDRED U.S. DOLLARS ($100). THIS LIMIT DOES NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Casa Is Home and its owners, brokers, agents, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

16. Suspension and Termination

We may restrict, suspend, or terminate access to the Services when reasonably necessary to protect the Services, users, or third parties; address suspected misuse; comply with law; or discontinue the Services. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

17. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal action arising from these Terms or the Services must be brought in the state or federal courts located in Los Angeles County, California, and each party consents to personal jurisdiction and venue there.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a revised effective date. Changes become effective when posted unless a later date is stated. If a material change affects an SMS program, we may provide additional notice when required. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

19. General Provisions

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, sale, or transfer of the Services or business. These Terms, together with the Privacy Policy and any additional terms presented for a specific service, constitute the entire agreement regarding the online Services.
